Adnan Sami’s remarriage with wife valid, says HC

The Bombay High Court on Tuesday said singer Adnan Sami’s second marriage with Saba Galadari is valid. Sami married Saba in 2001, divorced her in 2004 and remarried her in 2007. Their relations soured again and Saba moved a family court for divorce last year. She had also filed an application under the Domestic Violence Act and another application for getting back properties that Adnan had gifted her.
The family court held that Saba had not undergone halala procedure before marrying Adnan again so the second marriage was not valid as per Muslim law. She challenged the ruling in the HC. Division bench of Justice D B Bhosale and Justice R Y Ganu on Tuesday said halala was not necessary as Adnan had given her “single-pronouncement” (ahsan) talak (divorce) last time. Under halala a woman can remarry her former husband only after she first marries someone else and gets a divorce.
